I hope someone here could help me since I haven't had any replies back from when I posted on other help forums.
I have done multiple reinstalls and repairs, I did installs from Origin and from the disc. I removed all cc and mods I had in the game which was already a minimal amount and I also deleted my folders before I reinstalled. I did try compatibility mode but it didn't really help. I have tried running in windowed mode but the same thing happens.
I'm also using the 1.67 superpatch but before that I was using the 1.69 version with the origin install and they both had this problem.
I'll attach the important bits of my dxdiag here and WER7 in the diagnostics section was a failed install from one of my expansion pack discs probably because it's gotten scratched over the years in case anyone is wondering.
